Video and the Legal health record

    We are reviewing our Legal Health Record and I am wondering what other facilities do with video from robotic procedures, scopes and gait analysis. Are they part of your LHR? Also, how do you store video and for how long?

    Any guidance would be helpful.

    At our facility we would consider video to be source data.  It is not part of our Legal Health Record but could be considered part of our Designated Record Set.  I am not certain about the retention period for source data.

    I agree with Ms. Sanders. It could be a part of the Designated Record set and provided to the patient if requested, but would not be considered a part of the legal health record - AS LONG AS the interpretation of the video was placed within the legal health record. Regarding retention I would follow state laws for the type of medium.
