    Hi everyone,

    I am hoping someone can answer my question. Is there a law stating medical records cannot be release until the chart is complete (no deficiencies).
    I am not finding anything regarding this issue at hand.

    Hi, this is no law that I am aware of but more of an internal policy or procedure.

    There is no State law as previously mentioned, however there are best practices and communication.

     

    ·       We provide all records available at the time of processing, including unsigned notes.

    ·       If our ROI processing team knows that a particular note is not available because it has not been documented, then they contact the requestor and let them know.

    o   The requestor is advised that we're facilitating completion of the documentation (HIMS contacts the provider, etc.), and then the Team releases the records once the documentation is complete.

    We also have an internal policy not to release in draft status unless court ordered or subpoenaed.

    If in draft we reach out the the provider(s) that need to complete documentation to let them know there is a request for those documents and to complete as soon as possible.
