  • 1.  Workman's Comp Claims

    Our facility is located in NE. We send medical records to the work comp insurer for claims payment. We have a staffing agency who employs the patient requesting the medical records from an employment related injury to share with the company that the patient is working at. My question is since we provide this information to the insurance carrier; are we required and/or permitted to share this information with the employer? Does the disclosure to the employer require patient's signed authorization? The employer will get the information we sent to the insurance carrier from the insurance carrier, but it is not as timely as us sending the info directly to the employer and apparently the reason they are requesting the records directly  from us. We certainly want to provide the information if we are required/permitted to do so, but are a bit uneasy sending the records directly to the employer without the patient's signature.
