    Hello,
    I am looking for your views on the interpretation of 42CFR 2.23 Access and Restrictions  and 2.35 Criminal justice system.

    1. The revision for 2.23 states  "part 2 program is not required to obtain a patient's written consent or other authorization under the regulations in this part to provide such access to patient."   Are we to understand we no longer need a hipaa release from the patient/client to disclose information to themselves?   

    2.  For 2.35  "An individual in the criminal justice system who receives patient information may redisclose and use it .......  I am thinking we can make an "exception" clause on our hipaa release for these types of patient/clients. 

    I would appreciate any thoughts you may have on these new changes.   Thanks.

    Given all the freezes who knows when or if this will be implemented. I have not seen a good summary of these rules yet with interpretation useful to us in deciphering issues like this, so I can't help with your very good question. I'm advising to hold and see how these rules shake out and if it will ever get more rule making and implementation.

    Effective date has been announced - March 21, 2017.  Will be published tomorrow:

    SAMHSA  will be providing a series of guidance documents once the final rule comes out.

    I'm glad that run sheet helped you. I found this older post on this subject that talked about SAMSHA. I want to upload a PDF I created when I was working on a project recently.

    It has the most up to date for SAMSHA and a pdf file combined that has that run sheet in it.
