    Greetings,

    With the common use of phones as recording devices, our HIPAA Committee is reviewing our facility policy on the use of photographic devices in patient care areas. I was curious what other facilities allow or restrict regarding video recording. Anyone willing to share their policy is greatly appreciated.

    Here is our policy

    Photography, Video or other Digital Electronic Recording by Patient and/or Patient Family/Friends.
    1. Patient authorization is not needed for photography, video or other digital/electronic recording of the patient by the patient, patient's family members or friends where consent is implied by the patient.
    2. SIH employees individually can approve or refuse inclusion in photography, video or other digital/electronic recording by the patient and/or the patient's family members or friends.
    3. Photographing and video or other digital/electronic recording activity by the patient, and/or patient family members and/or friends is discontinued if the physician or SIH employee deems it necessary.
    4. Patient and/or patient family members and/or friends are prohibited from taking photographs, video or other digital/electronic recordings of SIH computer monitors or other electronic devices that display patient identifiable health information.

    I think it is very difficult to prohibit as a whole and there are times where it should be supported - births, visitor restrictions and resulting Face-time or Zoom operations, recording discharge instructions, etc.

    With that said - I feel very strongly that employees have rights too and they should not be recorded without their permission.   We have encouraged all of our staff to feel confident in asking patients and visitors to not record without permission and if the individuals are non-compliant we state in our policy that we may consider terminating patient-provider relationships and/or contacting law enforcement.
