Said company requests we send an employee's visit notes back to said Company, including past medical history of the employee.
We sent visit notes to companies prior to_________, understanding we should do this. Since _________ arrived, ______ says the employer should not receive these notes because they contain information the employer is not entitled to. Dr. J____ is also concerned his notes contain information the employer is not entitled to. Said Company is upset they are no longer receiving the information as they want it for their OSHA recordable list to dispute a condition is work related. Dr. ______ does make a determination on initial visit if the condition is work related or not, or undetermined.
I have reviewed the States Work Force rules on line as well as our consent. I would say both are open to interpretation.
