    Facility/Hospital has an agreement with an Employer to provide onsite Work Health services for their employees.  (Flu vaccines, work related injuries, new hire physicals, CPR forms, vision screening records, etc)  The facility provides an RN to staff the onsite office.  Paper records are generated and kept in the RN's office onsite at the Employer.  When the agreement is terminated, who owns these records?  The facility or the employer?

    It sounds to me that the Provider is providing a service and reimbursement is for the hours contracted.  The nurse is working on behalf of the employer and creating employee health records.  It does not seem that the employees are being "registered" as provider patients (or that is the usual case).  I would say that the employer should "own" the records as the employer is ultimately responsible for the records under OSHA and other laws impacting retention of employee records (personnel-type and/or health).

    I think Nancy outlined the answer beautifully. It sounds as though Employer has an onsite clinic and they can staff it with whomever they choose.
