1.  HIPAA Breach

Posted 13 days ago

A patient posted a video of his care in the emergency on YOU TUBE.    An employee of the hospital was tagged with the video and her husband shared with some of the other employees.   However, took it down within 3.5 minutes when the original employee realized it was posted.  HIPAA Breach??

I'm not 100% sure, but I would say no because the PATIENT took the video and posted it on a public forum (not the hospital employee w/o patient consent/authorization), so I don't know how they could make a case anyone breached PHI as the patient was the one who initially disclosed it in a public space/forum to begin with (YouTube). Did the patient file a complaint the hospital staff / husband shared it? If so that would be interesting.
