1.  Would you consider this a HIPAA Violation - Baby Daddy Drama

I am torn with this scenario... Bare with me as I explain a recent complaint against two of our clinicians ...  it is a mess! Ill try to keep it short...

A parent (we treat him/her child) came in and filed a complaint against two of our clinicians claiming "Breach of information".  Parent is not a client and has never been treated at our facility. But the parent seems to think that because child is a client then parent name and what happens in parent life is also "classified".

Parent of child was seen at a lake with clinicians #1, daughters ex-boyfriend/Father to unborn child whom I will refer to as baby daddy.. Clinician #1 heard from several different people within the community that parent and baby daddy were "together". Parent was really good friends with Clinician #2, so Clinician #1 asked Clinician #2, at work but outside of business hours, if the parent and baby daddy were "together" and Clinician #2 said yes. This resulted in a huge he said she said nightmare.

I have confirmed with all parities that the treatment of client was never discussed.  I am not sure that there is a legit claim here. Both clinicians are sequestered from the client and can't see any records. It has been this way since client has received treatment.

Yes- Clinicians need to act more professional.

​I may be missing something as this is confusing.  This type of thing is more prone to happen in small communities where people know each other.  I don't think it is a breach - perhaps poor judgment but not even sure of that.

I agree that this is not a breach as no PHI of the patient was released. Living in a small community this happens all the time because everyone knows everyone else.
